MOTION FOR REVIEW OF THE FUEL 
CLAUSE ADJUSTMENT

IN THE MATTER of the Fair Trading Commission Act, Cap.326B of the Laws of Barbados;
 
AND IN THE MATTER of the Utilities Regulation Act, Cap.282 of the Laws of Barbados;
 
AND IN THE MATTER of the Utilities Regulation (Procedural) Rules, 2003 and the Utilities Regulation (Procedural) (Amendment) Rules, 2009;
 
AND IN THE MATTER of the Motion to Review the Fuel Clause Adjustment pursuant to Section 16 of the Utilities Regulation Act, Cap.282 and Section 36 of the Fair Trading Commission Act, Cap.326B of the Laws of Barbados.
 
NOTICE IS HEREBY GIVEN that:
The Fair Trading Commission will be moved on the 29th day of May 2013 to commence a motion to determine the variance of the 1983 Public Utilities Board Decision and Order on the Fuel Clause Adjustment and the present Decision and Order of the Fair Trading Commission dated January 28, 2010. This Motion to review the FCA is in accordance with Section 36 of the Fair Trading Commission Act, Cap.326B and Section 16 of the Utilities Regulation Act, Cap.282 of the Laws of Barbados.
 
The Commission has determined that this Motion for Review of the FCA shall focus on:
1. The use of historic fuel cost vs. projected fuel cost; and
2. Smoothing as employed by the Barbados Light & Power Company Limited.
 
INVITATION TO INTERVENORS
 
With regard to the Fair Trading Commission’s Motion for Review of the FCA, any person who wishes to intervene in the upcoming proceedings is hereby notified that they must file a letter of intervention by 4:00 p.m. on the 7th day of June 2013. The letter of intervention must comply with the provisions of Rule 7 (as it relates to Rule 64 (6) of the Utilities Regulation (Procedural) (Amendment) Rules, 2009 (URPR)) copies of which are available at the Commission or its website.
 
1. During this hearing only those persons who have filed a letter of intervention in accordance with the criteria as set down in the URPR will be entitled to participate.
 
2. Copies of the said Motion and supporting documents and details of the letter of intervention can be viewed on the Commission’s website www.ftc.gov.bb or perused at the Commission’s office at “Good Hope”, Green Hill, St. Michael between the hours of 9:00 a.m. and 4:00 p.m. Mondays through Fridays.
 
3. Copies of the Utilities Regulation Act, the Fair Trading Commission Act, the Utilities Regulation (Procedural) Rules 2003, the Utilities Regulation (Procedural) (Amendment) Rules, 2009 relating thereto may also be viewed on the Commission’s website or perused at the Commission’s office.
 
4. The PUBLIC HEARING of the Motion to review the Fuel Clause Adjustment pursuant to Section 16 of the Utilities Regulation Act, Cap. 282 and Section 36 of the Fair Trading Commission Act will be convened by way of written hearing on the 29th day of May 2013.
